These Terms of Service (“Terms”) govern the use of the website https://vipheli.us (the “Site”) and the helicopter charter and sightseeing booking services (“Services”) provided by FLY4LESS LLC, doing business as VIPheli.us (“we,” “our,” or “us”).

By using our Site and Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

1. Services Provided

   • We act both as a direct helicopter operator and as a broker/agent connecting customers with licensed helicopter operators.
   • All flights are operated by FAA-licensed pilots and certified operators in compliance with applicable regulations.

2. Booking and Payments

   • Advance reservation is required. All bookings are subject to availability.
   • All bookings require full payment at the time of reservation through our designated payment provider.
   • Reservations are not confirmed until payment has been received.
   • A heliport fee of $15 per person applies and must be paid at the time of service, unless already included on your booking receipt.

3. Cancellation and Refund Policy

   • If the customer cancels:
   • 24 hours or more before flight: 100% refund.
   • Within 24 hours of flight: 50% refund.
   • No-show: No refund.
   • If the operator cancels (including due to weather, safety, or regulatory restrictions):
   • 100% refund will be issued to the customer.

   Refunds will be processed to the original payment method.

4. Passenger Responsibilities

   • All passengers must present a valid government-issued photo ID before boarding.
   • All passengers must sign a liability waiver before flight.
   • Passengers under 17 years of age must be accompanied by a parent or legal guardian.
   • Individual weights are required at booking. Passenger and baggage weights must be disclosed, discussed, and agreed upon with the operator prior to the flight.
   • Weight restrictions apply: Maximum 300 lbs per person. Maximum combined weight is 600 lbs.
   • Passengers must arrive at the designated departure point 15–30 minutes before departure.
   • Failure to comply with these requirements may result in denial of boarding without refund.

5. Safety and Conduct

   • Passengers must comply with all safety instructions provided by pilots and crew.
   • We reserve the right to refuse service to any passenger who:
     • Appears intoxicated or under the influence of drugs or alcohol
     • Poses a safety or security risk
     • Fails to follow crew instructions

6. Flight Day Procedures

   • Upon arrival at our location, our trained staff will escort you to the landing pad.
   • You will be assisted into and out of the aircraft by our crew.
   • Once airborne, you are free to take as many photos and videos as you like.
   • Standard scenic tours take approximately 15 minutes. Duration may vary by tour type.

7. Liability

   To the maximum extent permitted by law:

   • We are not liable for delays, changes, or cancellations caused by weather, air traffic restrictions, safety considerations, or regulatory requirements.
   • We are not responsible for passenger behavior or consequences of failure to follow crew instructions.
   • We are not liable for indirect, incidental, or consequential damages, including missed connections, lost opportunities, or other costs incurred by passengers.
   • Our liability in any case is limited to the amount paid by the customer for the affected booking.

8. Website Use

   • The Site may only be used for lawful purposes and legitimate bookings.
   • You may not misuse the Site, including:
     • Attempting unauthorized access or interfering with its operation
     • Copying, scraping, or extracting content without permission
     • Making fraudulent, speculative, or duplicate bookings
   • We reserve the right to suspend or terminate access for any misuse of the Site.

9. Governing Law

   These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA. Any disputes shall be resolved exclusively in the courts of Broward County, Florida.

10. Updates to Terms

    We may update these Terms from time to time without prior notice. The updated Terms will be posted on this page with a revised “Last Updated” date. Continued use of our Site or Services after such updates constitutes acceptance of the updated Terms.
